    # 挙証責任
    挙証責任が問題になるのは、実際の事件というか裁判で、争われた場合であって、なぜ争われるのかと言うと、それは「既にある表現を規制する法律が出来上がっている」場合です。
    正直、そういった法律ができてもいない状況では、挙証責任の話にはなりませんし、憲法判断が伴う訴訟においては、その挙証責任とやらが必ずしも規制(法律)を作った側にあるとは限りません。
