      Picrewに著作権トロールが発生し、騒動になっている (増田、はてブ)。そこで、代替サービスの著作権の扱いを調査した。結論から言えば、古き良きキャラクターなんとか機はすべてが自由であり、最高。

      だそうである。開発者たちの言動から言って、著作権で文句を言ってくることは心配しなくてもよさそう。

      余談

      3.distsn.orgではPicrewの利用を禁止している。問題のデータセットだけでなく、Picrew全体の利用を禁止していることは、過剰であると思われるかもしれない。しかしながら、Picrewの運営者が著作権トロールとSLAPPに対して有効な手を打てないならば、運営者も同罪である。

      99 %の著作権厨と1 %のエリート: 日本語圏のインターネットにおける法と正義

      慶応義塾大学の田中辰夫教授が「著作権厨」という用語を提唱した。田中によれば、「議論を阻む一番の障害が、著作権に非常にうるさく、現行の著作権法を絶対だとまきちらす『著作権厨』だ」とのことであり、「『著作権厨』という言葉を広め、その影響力を下げること」を目指しているという。

      私はかつて「法フィリア」という用語を提唱した。この用語も、念頭に置いているのは著作権法であったため、「著作権厨」と意味はほとんど同じである。わかりやすさで言えば著作権厨のほうが、優れているだろう。

      では、著作権厨または法フィリアとは、実際にはどのような人たちなのだろうか？ 日本語圏のマストドンの鯖缶界隈を例に見てみよう。

      日本語圏のマストドンの鯖缶界隈も、メンタリティは著作権厨に近い。GDPR、刑法175条、著作権法といったこまごまとした法や規則に、常におびえている。自分たちのインスタンスが違法にならないことに神経を注ぐ一方で、分散SNSやインターネットがどうあるべきかを考えている者は少ない。THE_BOSSが刑法175条との戦いを通してリベラルな意見を表明していたことが、稀有な例外であろう。

      マストドンの鯖缶が務まるくらいなのだから、技術も知性も、インターネットの平均的なユーザーよりはだいぶ上なはずである。この例からすると、著作権厨の何が問題なのか理解できるのは、ごく少数のエリートだけだろう。慶応大学の田中教授に代表されるような上位1 %のエリートたちが、インターネットの著作権厨を発見するのに2019年までかかってしまったのは、遅きに逸した感がある。

      あるいは、インターネットのユーザーの過半数は、そもそも著作権という概念を理解していないのだろうか？ 漫画村が注目されてからというもの、出版社たちが無知な民衆を「啓蒙」することで、大量の著作権厨を作り出そうと奮闘しているのは、皮肉な成り行きである。
